I’m sure you’re aware that the activity you describe is classified a hate crime under section 775.085 of the Florida Statutes, which define hate crime as “a crime in which the perpetrator intentionally selects the victim based on one of the following characteristics: race, color, religion, ethnicity, ancestry, national origin, sexual orientation, advanced age or mental/physical disability.” The crimes, in this case, would be arson, “to unlawfully and intentionally damage, or attempt to damage, any real or personal property by fire or incendiary device” and intimidation, “to unlawfully place another person in fear of bodily harm through verbalthreats without displaying a weapon or subjecting the victim to actual physical attack.”
If Mr. Pagan does release his video as planned, I hope readers of this site will join me in distributing copies of it on the Internet. Particularly to the Hillsborough County Sheriff’s Office and the Tampa Police Department. I’m sure they’ll find it a real hoot!

I’m not so sure of that. True, the ACLU represented a Klansman in a Virginia hate-crime case that was later overturned by the Supreme Court. However, the issue was not so much the cross-burning as Virginia’s presumption of intimidation. I don’t believe that in this case intimidation would need to be presumed. It is a clear and stated goal.
Now, Jay might be able to burn a Quran on his own property and have it indeed be a protected form of free speech. However, the act of filming it and then posting it to a web site already filled with anti-Muslim and anti-Leftist hate speech, and combined with the death threats he’s already levied against me and other posters here and Muslims in general, could make this far more than a simple First Amendment case.
Now, Mr. Pagan may try to make the point that by burning the Quran and the flags of several countries that he is merely engaged in an act of protest against the policies of those countries. But again, his legacy of hate speech demonstrates that the “policy” he objects to is that they exist in the first place.

You are correct of course in all of your points. However, I tend to err on the side of the 1st amendment always. Perhaps you agree, perhaps not. Again, you are correct in stating that all the Twagger’s previous rantings do constitute a deranged and disturbing pattern of hate and threatened violence. My only point is that if he wants to burn a flag, or a book, on his own property, then by all means do it and do it safely. If he wants to post the video of himself doing it, he can do that too. The freedom he has stops immediately when he takes someone else’s Koran and damages it, if he harms another human being due to his ideology etc.
I never said the ACLU was perfect, I merely meant that they were necessary (in an idealistic sense) to the lifeblood of a free and open society. We can always debate the specifics.
Trajan, as much as it sucks, is free to spew all the hate speech he wants until he incites violence. He has tried most certainly, and I think we should begin reporting him regularly and he may find out where the limits of free speech are. Until then, he can keep spewing, it’s entertainment for us and only serves to prove what a moron he personally is.
